Company has cash reserves from recent sale of trade (€700k) and also owns a building premises (€400k). Part of premises was used by trade and part was rented out as commercial unit. The shareholders now want to liquidate company but want to retain building ownership. Does the property need to be sold to shareholders prior to liquidation as it can not be passed in specie in order to claim Entrepreneur relief ? (as per CGT retirement relief). Is Entrepreneur relief restricted to the building proceeds relating to portion used by trade?
