Question asked:

Hi Alan, I have a client who does not qualify for Retirement Relief as he didn't work in his business for the last 10 years, his son ran it) He now wants to pass the business to his children and I am looking at Entrepreneur relief instead. He meets the ownership criteria (it is not a company it is a commercial premises and his sole trade was operating out of it, the son now operates the trade for him) He meets the criteria of owning the business / trade the last 3 out of 5 years. But is he still able to claim ER if he didn't operate the trade himself. If he needs to also have operated the trade could we go back and do form 11 for him the last 3 years to show a case I income from it. Thanks Fiona
