The company has one customer - a business based in the US with which it has an exclusivity agreement - that is invoiced on a monthly basis for revenue derived from video advertisements placed in mobile games. The company does not deal with any businesses in Europe, nor any non-business customers. As i understand it the company is therefore designated as not eligible for VAT, but am concerned that the year-end company revenue will exceed the 37,500 euro threshhold and perhaps there isa place of supply rule that potentially makes this vatable?

The service is B2B and is taxed where the recipient is established or resides: VATCA 2010 s 34(a). So it is zero-rated. But the supplier of the service needs to register if his turnover exceeds €37,500 in any continuous 12 month period.

Thanks Alan - so we just register for VAT and account for VAT on the reverse charge basis (T1/T2 making a nil return)?
