Hi Alan, Client is a GP and has another GP working who is paid via PAYE system. However, she also has her own GMS list and witholding tax on this in her own name and does a self employed return for the tax due on this. She uses his surgery and facilities to see these patients. Client has asked me to review the tax compliance of this arrangement. As she uses his surgery I am concerned that Revenue would treat this as employment (employment v self employment guidelines) and seek PRSI at A class from him. Is this situation acceptable to Revenue or would they seek to have her GMS income included in the practice accounts and the full amount paid to her as salary? If yes, what will happen the withholding tax she suffers? Or is the fact she has her own GMS list enough to qualify her as self employed? Thanks David
