Alan, Husband & wife owned section 48 lands, they built 5 houses in late 90's and got Section 48 approval and had been filing a joint return claiming writing down allowance up to 2003, when they separated. Judicial spearation in 2009. From 2004 we filed husbands tax return(married but living apart) and claimed his 50% share of section 48 allowances till it was exhausted in 2010. Wife has now approached us stating whilst she did file a return from 2004 to 2010, she never claimed the section 48 relief. . She wants us to contact inspector to see if we can back claim the unclaimed section 48 relief(e43,117 for this period, per what hubby claimed for this period) now? There are also capital allowances she did not claim for thsi period. Can we do this? If so how would we go about it. (She was very sick during this period 2004 onwards) Thanks

There is no problem filing amended returns for 2004-2010, but refunds if any will only be paid (and offset made) for 2009-2010.
