Hi Alan,
We have a client Irish resident,ord res & Irish dom. He worked for the uk navy and has started receiving a pension of about £15,000 stg per year and he is paying U.K. tax on it.
Am I right in saying that the treaty would suggest that it is only taxable in Ireland – therefore any tax paid in the UK is irrelevant, should not have been deducted and no credit available for such in Ireland.
Maybe you could clarify this for me and any references to the treaty would be great.
