I note from the revenue guidance on payments arising from claims made under employment law that some are taxable and some are not in the hands of the recipient. What is the treatment for the payments from the employers point of view? if its taxable to the ex employee, its tax deductible to the ex employer?

I think if it is salary or payment in lieu of emoluments it is allowable.
If arises from some misdemeanour or illegal activity by the employer I think not.
