Question asked:

Hi Alan, Our client has owned and operated a business for 15 years. He is looking to sell the business and claim retirement relief. The business is owned by him personally and not through a company. All the conditions for retirement relief have met, but with one problem. Due to ill health, he leased the business for 18 months (circa 3 years ago). My understanding is that the business assets will not be his chargeable business assets throughout the period of 10 years ending with that disposal. Thus, retirement relief will not be available. I just want to check that my conclusion is correct. Many thanks for your assistance.
