My client has received an inheritance from his brother – house, lands & cash. The grant of probate issued on the estate on the 16th August, 2018. However there is a claim pending against the estate by someone who carried out works to the deceased and was told they would be ‘looked after in the will’. This person was not however named as a beneficiary in the will and has now lodged a claim. So whilst the probate has issued, the solicitors cannot distribute the estate pending conclusion of the proceedings regarding the claim. Would my client still be consider beneficially entitled on the date the grant of probate issued or would the pending claim impact on this?
