Commencement of sections 100, 101 and 102

Section 103 provides that the Temporary Business Energy Support Scheme (TBESS) provisions do not take effect automatically but require the Minister for Finance to formally bring them into operation by order.

  • Sections 100, 101 and 102 (the TBESS provisions) do not come into effect on the date the Finance Act 2022 is passed.
  • The Minister for Finance must make a commencement order to bring these sections into operation.
  • This mechanism is required because the TBESS constitutes a State aid, which must receive approval before it can be activated.
  • The commencement order was subsequently made as SI 684/2022 (Finance Act 2022 (Sections 100, 101 and 102) (Commencement) Order 2022).
