Transitional provisions

Section 120 ensures the continuity of Revenue's powers and of capital acquisitions tax law following the consolidation of the earlier legislation into the 2003 Act.

  • Revenue retain all jurisdictions, powers and duties in relation to CAT that they held under the pre-consolidation legislation.
  • The continuity of CAT law is preserved despite the replacement of the earlier enactments by the consolidated Act.
  • Any reference in legislation or documents to a provision of the consolidated Act may, where appropriate, be read as including a reference to the corresponding pre-consolidation provision.
  • Any reference in legislation or documents to a pre-consolidation provision may, where appropriate, be read as including a reference to the corresponding provision in the consolidated Act.
