Appeals regarding value of real property

Section 66 provides a right of appeal where a person is aggrieved by a Revenue decision on the market value of real property (land and buildings) for Capital Acquisitions Tax purposes.

  • A person who disagrees with Revenue's valuation of real property may appeal to a property arbitrator appointed by the Land Values Reference Committee.
  • The appeal process follows the procedure set out in the Finance (1909-10) Act 1910 and the Property Values (Arbitration and Appeals) Rules 1961, with either side able to appeal the arbitrator's decision to the Circuit Court or High Court.
  • In any such appeal, particulars delivered for stamp duty purposes in relation to a property transfer or lease are accepted as prima facie evidence of the matters stated in them.
  • This section applies only to disputes over the market value of real property; appeals on all other Capital Acquisitions Tax matters are dealt with under section 67.
