Rules of court

Section 24 deals with the power to make procedural rules when a court is given new or changed responsibilities by legislation.

• When legislation gives a court a new area of responsibility, or changes an existing one, procedural rules may need to be updated accordingly.
• The body that already has authority to set the court's procedural rules is automatically empowered to make rules for the new or altered responsibility.
• This rule-making power can be exercised at any time — there is no requirement to act immediately when the new jurisdiction comes into effect.
• This ensures courts can operate smoothly under new or amended legislation without needing a separate grant of rule-making authority each time.
