Interpretation Act 2005 section 25

Service by post

Section 25 sets out the rules for when a document is considered to have been validly served by post under any piece of legislation.

  • Where legislation requires a document to be "served", "given", "delivered", "sent" or uses any similar term, posting is a valid method of service.
  • The document must be enclosed in a letter that is properly addressed and, where necessary, has the correct postage prepaid.
  • Service is presumed to have taken place at the time the letter would normally be delivered in the ordinary course of post.
  • This presumption of delivery can be challenged β€” it applies only unless the contrary is proved.
