References in enactments to Parts, etc.

Section 9 establishes how cross-references within legislation should be interpreted when they do not specify which enactment or provision they relate to.

  • When a piece of legislation refers to a Part, Chapter, section or Schedule without specifying which Act, it means a Part, Chapter, section or Schedule of that same piece of legislation.
  • Similarly, when a provision refers to a subsection, paragraph, subparagraph, clause or article without further specification, it means a subsection, paragraph, subparagraph, clause or article within that same provision.
  • This rule applies regardless of the particular name used for the division of the legislation.
  • The rule operates at two levels: higher-level divisions (Parts, Chapters, sections, Schedules) refer back to the enactment, while lower-level divisions (subsections, paragraphs, clauses) refer back to the provision in which they appear.
