Customs Act 2015 section 12A

Customs control at customs ports

Section 12A sets out the obligations of a person in charge of a vehicle carrying goods that has arrived by ferry at a customs port from outside the EU, and the penalties for non-compliance.

  • The person in charge of a vehicle unloaded from a ferry at a customs port must follow Revenue Commissioners' instructions to move the vehicle to a designated customs supervision area.
  • The vehicle must remain at that designated area, and the person must comply with any further instructions from Revenue, until clearance to depart is given.
  • Failure to follow these instructions or to keep the vehicle at the designated area, without a lawful excuse, is a criminal offence.
  • A person convicted of such an offence faces a fine of up to €5,000, imprisonment for up to 12 months, or both.
