Customs Act 2015 section 50

Prohibited or restricted goods on importation or exportation

Section 50 defines what constitutes prohibited or restricted goods for customs purposes and confirms that customs powers apply to the enforcement of any import or export bans or restrictions imposed by law.

  • Any goods banned or restricted from import or export under any legislation are treated as "prohibited or restricted goods" for customs purposes
  • This applies regardless of which specific law imposes the prohibition or restriction
  • All provisions of the Customs Acts apply to these goods, including powers to stop, search, examine and seize
  • The section acts as a bridge, linking prohibitions and restrictions found in other legislation to the enforcement powers available under customs law
