Customs Act 2015 section 25

Power to enter, inspect and patrol certain places

Section 25 sets out the powers of customs officers to enter, inspect and patrol customs ports, airports, coastal areas and land near the border, without a warrant, for the purpose of carrying out their duties under the Customs Acts.

• Customs officers and their assistants may enter and inspect customs ports, airports, approved places and any conveyances within them at any time and without a warrant.
• Officers may freely patrol coastlines and any land within 32 kilometres of the land border, and may remain in those areas for patrols or surveillance.
• Officers may be accompanied by other persons and may bring any equipment, vehicles, vessels, aircraft, customs dogs or other items needed to carry out their duties.
• Anti-smuggling vessels under the control of a customs officer may be anchored, moored, berthed or hauled ashore at any place within the State at no cost to the State.
