Liable person to pay unpaid local property tax on sale of property

Section 126 requires a liable person to pay all outstanding local property tax, penalties, and interest on a residential property before the sale of that property is completed.

  • A liable person selling a residential property must settle all outstanding LPT, penalties, and accrued interest with Revenue before the sale completes.
  • This obligation applies even where the LPT has not yet reached its normal payment due date.
  • The requirement is subject to the deferral provisions relating to relevant events under the Act.
  • The effect is that a property cannot be sold with outstanding LPT liabilities still attached to it.
