Charges on property following sale

Section 127A protects a new property owner from having a charge attached to their property for unpaid local property tax that relates to a period before they purchased it, provided certain conditions are met.

  • Where a residential property is sold and the new owner files a full and accurate local property tax return for the first liability date after the sale, any unpaid LPT from before the sale does not attach as a charge on the property.
  • This protection only applies where the outstanding tax was not already included in a Revenue estimate, Revenue assessment, or self-assessment made before the sale took place.
  • The protection extends to any accrued interest associated with the unpaid pre-sale LPT, not just the tax itself.
  • The new owner must make a full and true disclosure of all matters necessary to establish the correct LPT liability in their return for the protection to apply.
