Revenue estimate becomes due and payable

Section 49 deals with what happens when a liable person receives a Revenue estimate for local property tax but fails to file a return with a self-assessment and chosen payment method.

  • Where Revenue issues an LPT estimate to a liable person, that person should respond by filing a return containing a self-assessment and selecting a payment method.
  • If the person fails to file such a return, the Revenue estimate becomes due and payable as though it were a formal Revenue assessment.
  • This means the estimated amount carries the same legal force and collection powers as an actual Revenue assessment, including enforcement measures.
  • There are exceptions where the person claims they are not a liable person, or where Revenue proceeds to make a formal assessment, in which case different rules apply.
