Application of certain provisions of the Act of 1997

Section 148 provides that certain penalty-related provisions from the Taxes Consolidation Act 1997 apply, with any necessary modifications, to penalties arising under the Local Property Tax Act.

  • Existing income tax penalty rules from the Taxes Consolidation Act 1997 are applied to Local Property Tax penalties, covering assessment, collection, court proceedings, and time limits for recovery.
  • Revenue may assess and collect LPT penalties as if they were amounts of tax, and may bring proceedings even where the exact penalty amount cannot be definitively established.
  • Penalties may be mitigated by Revenue, and there are defined time limits within which penalties must be recovered.
  • Giving false evidence in LPT penalty proceedings is punishable as perjury, and rules on the admissibility of statements and documents in criminal and tax proceedings also apply.
