Obligation on liable person to prepare and deliver a return

Section 35 sets out the obligation on persons liable for local property tax (LPT) to prepare and file returns with Revenue, and explains when repeat returns are not required within a valuation period.

  • Every liable person must prepare and deliver an LPT return to Revenue by the return date, on a self-assessment basis, even if Revenue has not issued a notice requiring one.
  • Once a valid return has been filed for the first liability date in a valuation period, no further returns are needed for subsequent liability dates in that period, provided the LPT continues to be paid using the agreed payment method.
  • A new return is required where a building becomes residential between valuation dates, where there is a change of liable person and the chargeable value appears unreasonable, or where a property was acquired from certain exempt first-time buyers before 1 May 2013.
  • Where a deferral is claimed, the amount payable is adjusted accordingly, and where certain exemptions apply on a liability date, modified return rules apply so that no tax is due for that date.
