Grants of probate

Section 26 sets out the High Court's powers to grant, limit, and revoke grants of probate in respect of a deceased person's estate.

• The High Court may grant probate to one or more of the executors named in a deceased person's will.
• A grant of probate may be limited in any way the Court considers appropriate.
• The High Court has the power to revoke, cancel, or recall any grant of probate it has issued.
• This section forms part of a broader group of provisions (sections 26 to 44) that consolidate and amend the law on grants of representation.
