Devolution of real and personal estate

Section 10 establishes that all property of a deceased person β€” both real estate (land and buildings) and personal estate (everything else) β€” automatically passes to and vests in the personal representatives upon death, regardless of any will.

  • On death, all real and personal property of the deceased automatically vests in the personal representatives, regardless of any directions in a will.
  • The personal representatives are treated in law as the heirs and assigns of the deceased for the purposes of all trusts and powers.
  • The personal representatives hold the estate as trustees on behalf of those legally entitled to inherit, and they represent the deceased in all matters relating to the estate.
  • The property covered includes anything the deceased was entitled to that does not simply cease on death, as well as property over which the deceased exercised a general power of appointment by will.
