Acting district probate registrars

Section 131 deals with the temporary cover arrangements when an acting district probate registrar is absent or incapacitated through illness.

  • Where a person has been appointed as acting district probate registrar by the Minister under the Court Officers Acts, a further temporary replacement may be needed if that person is absent or ill.
  • The Minister may authorise a specified officer from the same district probate registry, or from the circuit court office serving the same area, to step into the role during such absence or illness.
  • The authorised officer takes on all the powers and duties of the district probate registrar for that district while covering the role.
  • The temporary authorisation remains in effect during any period of absence or incapacity unless the Minister directs otherwise.
