Partial intestacy

Section 74 deals with what happens to the portion of a deceased person's estate that is not covered by their will.

  • Where a will only disposes of part of the deceased's estate, the remainder is treated as if there were no will for that portion.
  • The undisposed portion is distributed according to the rules of intestacy.
  • For the purposes of distributing the remainder, it is treated as though the deceased left no other estate.
  • The intestacy rules apply only to the portion not covered by the will; the rest of the estate passes as directed by the will.
