Dispositions made on board vessel or aircraft

Section 103 provides an additional rule for validating the form of a will made on board a ship or aircraft, by reference to the law of the place most closely connected with that vessel or aircraft.

  • A will made on board a vessel or aircraft may be validated under this section in addition to the rules already available under section 102.
  • The will is valid as regards form if it complies with the internal law of the place with which the vessel or aircraft had the most real connection.
  • The most real connection is determined by considering the vessel's or aircraft's registration and any other relevant circumstances.
  • This provision does not replace or limit section 102 but offers a further basis on which formal validity may be established.
