Half-blood

Section 72 establishes that half-blood relatives are treated equally with whole-blood relatives for the purposes of intestate succession.

  • Half-blood relatives (sharing one parent) have the same succession rights as whole-blood relatives (sharing both parents)
  • Half-blood and whole-blood relatives of the same degree of relationship inherit equally
  • This replaced the previous rule where whole-blood relatives had preference when inheriting real estate (land and buildings)
  • The old law already treated half-blood and whole-blood relatives equally for personal property (personalty), and this section extended that equal treatment to all types of property
