Revoked will not revived otherwise than by re-execution or codicil

Section 87 sets out the rules governing how a revoked will can be brought back into effect, and the limitations on what is restored when a previously partly revoked will is revived.

  • A will (or any part of a will) that has been revoked cannot be brought back into effect simply by wishing it so β€” it must be formally revived.
  • Revival can only be achieved in two ways: by re-executing the will itself, or by making a new codicil that is properly executed and clearly shows an intention to revive the earlier will.
  • Where a will was first partly revoked and then later wholly revoked, reviving that will does not automatically restore the parts that were removed during the earlier partial revocation.
  • The partly revoked portions can only be restored if the person reviving the will shows a clear intention to bring those earlier-removed parts back into effect as well.
