Jurisdiction

Section 6 sets out which courts have the authority to hear and decide cases arising under the Succession Act 1965, and the limits on the Circuit Court's jurisdiction.

• The High Court has full jurisdiction over all matters arising under the Succession Act 1965.
• The Circuit Court shares jurisdiction with the High Court for disputes over grants or revocations of representation, estate administration matters, and certain specific proceedings (such as appropriation of a dwelling, spousal legal rights, provision for children, and anti-disinheritance claims).
• The Circuit Court's jurisdiction is limited where the deceased's real estate exceeds a rateable valuation of £200, unless all necessary parties consent in the prescribed form.
• Circuit Court cases must be heard by the judge of the circuit where the deceased had a fixed place of abode at the time of death.
