Assistant Probate Officer

Section 128 defines the role of the Assistant Probate Officer and sets out the scope of their authority to act in place of the Probate Officer.

  • The Assistant Probate Officer is the officer next in rank to the Probate Officer within the Probate Office.
  • The Assistant Probate Officer must be qualified to hold the position of Probate Officer.
  • The Assistant Probate Officer may exercise all the same powers, duties and functions as the Probate Officer.
  • The President of the High Court may impose restrictions on what the Assistant Probate Officer is permitted to do.
