Section 9 preserves certain existing legal provisions and duties from being overridden by the Succession Act 1965, and clarifies that the Act generally applies only to the estates of persons dying after its commencement.

  • Existing laws that allow small payments from a deceased person's estate without requiring a formal grant of probate or administration remain unaffected by this Act.
  • Subject to section 118, the Act does not alter any death duties payable on real estate, nor does it interfere with existing methods for recovering such duties β€” though succession duty is calculated using the distribution rules set out in this Act.
  • The Act generally does not apply to the estate of anyone who died before it came into force, unless a specific provision states otherwise.
  • The Act applies to the will of every person who dies after its commencement, regardless of when the will was originally made.
