Shares of parents

Section 68 sets out how the estate of a person who dies intestate is distributed among their surviving parents, where the deceased left no spouse, civil partner, or children.

  • Where the deceased left no spouse, civil partner, or children, the estate passes to the surviving parents
  • If both parents survive, they share the estate equally between them
  • If only one parent survives, that parent inherits the entire estate
  • Special rules apply where the deceased is an "affected person" and a surviving parent is both the biological father and the social father β€” that parent still receives an equal share alongside any other surviving parents, not a double share
