Appointment by personal representatives of trustees of infant's property

Section 57 deals with the appointment of trustees to hold and manage a minor's share in a deceased person's estate when no existing trustees are available or willing to act.

  • Where a minor is entitled to a share in a deceased person's estate and there are no trustees able and willing to act, the personal representatives may appoint trustees to hold that share on behalf of the minor.
  • The appointed trustees may be a trust corporation, or any two or more individuals, and the personal representatives themselves may be among those appointed.
  • If the personal representatives do not make any such appointment, they automatically become the trustees of the minor's share by default.
  • Once trustees are formally appointed, the personal representatives are released from any further liability in respect of the property transferred to those trustees.
