Executor admissible as witness

Section 84 confirms that a person who is named as an executor in a will is not prevented from acting as a witness in relation to that will.

• An executor of a will is a competent witness to prove the execution of the will.
• An executor is also a competent witness to prove the validity or invalidity of the will.
• The mere fact that a person is appointed as executor does not disqualify them from giving evidence about the will.
• This provision removes any suggestion that an executor's interest in the will creates a conflict preventing them from being a witness.
