General devise of land to include leasehold as well as freehold

Section 92 establishes that when a will contains a general gift of land, it automatically includes both freehold and leasehold property unless the will specifically states otherwise.

  • A general gift of land in a will covers both freehold and leasehold interests.
  • No separate or specific mention of leasehold property is needed for it to pass under a general land devise.
  • The testator can override this rule by including a contrary intention in the will.
  • This provision prevents leasehold property from being unintentionally excluded when a will refers broadly to "land".
