Deposit and inspection of wills and other documents

Section 42 sets out the requirements for depositing, preserving, and inspecting original wills and related documents in the Probate Office.

  • Original wills for which probate is granted must be deposited in the Probate Office.
  • Copies of wills whose originals are kept in district probate registries must also be deposited in the Probate Office.
  • The President of the High Court controls the preservation of these documents and sets the rules for inspecting them.
  • These arrangements are subject to the Public Records (Ireland) Act 1867, which allows for the eventual transfer of records to the Public Record Office for safe keeping.
