Validity of conveyance not affected by revocation of representation

Section 25 protects purchasers who have bought estate assets from a personal representative, by ensuring that the sale remains valid even if the grant of representation is later revoked or changed.

  • Any conveyance of an estate or interest in a deceased person's estate made by a granted representative to a purchaser is valid, regardless of any later revocation or variation of that grant.
  • This protection applies to conveyances made both before and after the commencement of the Act.
  • The section does not override any court order made before the Act commenced.
  • The rule applies whether the deceased person died before or after the Act came into force.
