Grants of administration

Section 27 sets out the powers of the High Court to grant, limit, and revoke administration of a deceased person's estate, and the rights and responsibilities of those appointed as administrators.

  • The High Court may grant administration of a deceased person's estate (with or without a will annexed) and may limit, revoke, cancel, or recall any such grant.
  • The order of priority for who receives a grant of administration is determined by High Court rules, but the Court may depart from those rules in special circumstances.
  • An administrator, once appointed, has the same rights, liabilities, and accountability as if they were the executor named in the will, subject to any limitations in the grant.
  • Where legal proceedings are pending regarding the validity of a will or a grant, the Court may appoint a temporary administrator who has full powers except the right to distribute the estate, and who acts under the Court's direct control.
