Succession Act 1965 section 14

Construction of references to estates of deceased persons

Section 14 establishes that references to a deceased person's estate in the Succession Act and later legislation include both real property and personal property, unless the context indicates otherwise.

  • The word "estate" in relation to a deceased person covers both real estate (land and buildings) and personal estate (all other assets).
  • This definition applies throughout the remainder of the Succession Act 1965.
  • It also applies to any legislation enacted after the Succession Act, unless a contrary intention is expressed.
  • The purpose is to eliminate the historic legal distinction between real property and personal property in the context of succession.
