Legitimated, illegitimate and adopted persons

Section 110 addressed the succession rights of legitimated, illegitimate and adopted persons, but has been substantially amended by the Status of Children Act 1987.

• This section originally dealt with how legitimated, illegitimate and adopted persons were treated for the purposes of succession law.
• The Status of Children Act 1987, section 32(h), made significant amendments to this provision.
• The 1987 Act broadly aimed to equalise the legal status of children regardless of whether their parents were married to each other.
• The practical effect is that, for succession purposes, the distinction between legitimate, legitimated, illegitimate and adopted persons has been largely removed.
