Joint dispositions

Section 105 confirms that the rules governing the form and execution of wills apply equally where two or more people make their testamentary wishes in a single document.

  • A joint will is a single document containing the testamentary dispositions of two or more persons.
  • All the formal requirements that apply to an individual will also apply to a joint will.
  • Each person making dispositions in the joint document must comply with the same execution rules as if they had made a separate will.
  • This provision ensures consistency of formalities regardless of whether a will is made individually or jointly.
