Second and subsequent grants

Section 37 establishes that any further grants of probate or administration must be issued from the same office that made the original grant.

  • Where a second or subsequent grant is needed in relation to an estate, it must come from the same office as the original grant.
  • The original grant may have been issued from either the Probate Office or a district probate registry.
  • This rule ensures that all grants relating to the same estate are handled consistently by one office.
  • This means any party seeking a further grant must apply to the office that dealt with the matter originally, rather than to a different office or registry.
