Official copies of wills and grants

Section 43 deals with the right to obtain official copies of wills and grants of representation, and the evidential status of those copies.

  • Official copies of all or part of a will, or of a grant of representation, can be obtained from the Probate Office or the relevant district probate registry.
  • The copy must be sourced from the office or registry where the will was proved or the grant was made.
  • An official copy of a grant of representation serves as sufficient evidence of the grant itself.
  • This evidential status applies to grants made both before and after the commencement of the Succession Act 1965.
