Interpretation

Section 1 defines the terms and expressions used throughout the Stamp Duties Consolidation Act 1999 and sets out rules for construing cross-references within the Act.

  • Defines key terms including "accountable person", "bill of exchange", "child", "conveyance on sale", "marketable security", "residential property" and "stamp", among many others.
  • Identifies the accountable person for each category of chargeable instrument, such as the purchaser or transferee on a conveyance or transfer on sale, and the lessee on a lease.
  • Excludes the National Treasury Management Agency and the Minister for Finance (in respect of functions delegable to the NTMA) from being accountable persons.
  • Provides that references in the Act to enactments, Parts, sections, subsections and similar divisions are internal cross-references unless another enactment is specifically indicated.
