Surrender and merger of leasehold interests

Section 67 charges stamp duty on an instrument that bears witness to, or acknowledges, the surrender of a leasehold interest in land or buildings, or the merger of such an interest into a superior interest.

  • A document that records or acknowledges the surrender of a leasehold interest is chargeable to stamp duty.
  • This applies whether the surrender itself was made orally (by parol), by conduct, or in writing.
  • The same treatment applies where the leasehold interest merges into a superior interest in the property.
  • The document is charged to the same duty as if it were itself a surrender of the leasehold interest.
