Stamp Duties Consolidation Act 1999 section 74

Section 74 provided a stamp duty exemption for an instrument transferring securities, on a sale, to a market maker (or its nominee) acting in the ordinary course of its market-making business.

  • Removed the stamp duty charge on an instrument transferring securities, on a sale, to a market maker.
  • Required the market maker to be acting in the ordinary course of business as a market maker in securities of the kind concerned.
  • Also covered a transfer to a person acting as the nominee of the market maker.
  • The section was deleted by the Finance Act 2007 section 109, and repealed by section 69 of the Finance Act 2022, so it no longer applies.
