Repayment of stamp duty on certain transfers of shares

Section 84 provides for the repayment of the stamp duty paid on the transfer on sale of shares by a participant in an approved profit sharing scheme who has held those shares until the release date.

  • Revenue must repay the stamp duty paid on an instrument that transfers shares, by or on behalf of a participant in an approved profit sharing scheme, on or after the release date.
  • The relief applies to the duty charged under the "Conveyance or transfer on sale of any stocks or marketable securities" heading in Schedule 1.
  • The terms "approved scheme", "participant", "the release date" and "shares" take their meanings from section 509 of the Taxes Consolidation Act 1997.
  • Section 84 sets no time limit, but a valid claim must be made within four years of the date the instrument was stamped under section 159A, and interest may be due under section 159B.
