Relief for intermediaries

Section 75 provides relief from stamp duty for brokers and dealers who purchase stocks or marketable securities of Irish incorporated companies on behalf of clients.

  • An instrument transferring securities to a recognised intermediary or a member firm of an exchange or market is exempt from stamp duty.
  • An intermediary is a bona fide dealer in securities (including derivatives); a member firm is a member of the Irish Stock Exchange, the London Stock Exchange, or another Revenue-approved exchange or market.
  • The exemption applies only where the transfer is effected on a qualifying exchange or market and is not connected with an excluded business.
  • Revenue may approve recognised intermediaries, designate exchanges or markets by regulation, and inspect an intermediary's books and records.
